Leasehold Questions
Are the properties sold Freehold or Leasehold?
Each property is sold on the basis of a 999 year lease. All the owners will enjoy full rights to use the communal areas of Brunel Quays during their residency.
Will there be a management company?
Yes, Fowey River Development Management Company Ltd has been set up to manage the development and organise the communal areas including the parking etc. The Freehold is also owned by FRDC Ltd and they will maintain all the common areas, external landscaping to ensure carefree ownership.
Are there any other charges I will have to pay on top of the purchase price?
FRDC Ltd require a yearly service charge to cover the ground rent cost and agreed services of general maintenance, external window cleaning, landscaping/ gardening, communal TV system maintenance, communal fire extinguisher maintenance ( if applicable) refuse collection, building insurance and auditor payments, communal water (outside taps) and electricity payments for external lighting and finally a sinking fund to provide suitable funds for larger items of maintenance in the future.
Is there a fee payable to reserve the property of my choice?
Yes , a non refundable fee of £1000 to reserve your property payable to Fowey River Development Company Ltd. A further 10% of the full price is payable on exchange of contracts.
When will my property be completed and handed over to me?
All purchasers will be given due notice of the final handover date this is to be confirmed shortly
Can I let my property out?
Yes – this is permitted under the terms of the lease. Your tenant will be subject to the provisions contained in your lease which sets out certain standards and governs the use of the development .
What are the parking arrangements?
Each property will have one numbered parking space (position to be confirmed)
Can I or my solicitor make any changes to the lease?
No – the lease has been made to be fair to all parties. Each property is sold on the basis of the same standard lease to ensure each owner is subject to the same rules.
Reservation Procedure – The Carriageworks Brunel Quays
- In order to reserve the property of your choice, you will pay a reservation fee of £1000 to Fowey River Development Company Ltd ( the project company for Wombwell Homes on this development). In the event of a change of mind and withdrawal from the proposed purchase, FRDC ltd retain the reservation fee to cover administrative costs.
- Within 40 days of receipt of draft contracts by your appointed solicitor FRDC Ltd will require an exchange of contracts with a further payment of 10% of the purchase price, which, with your reservation fee will form the fixed deposit.
- If your purchase is subject to the sale of your own property, we will accept a conditional exchange of contracts. We will advise you of a completion date of your purchase and you will have due notice to complete the purchase. In the event of you being unable to achieve this timescale you will be subject to the terms and conditions of sale. FRDC Ltd will then reserve the right to re-offer the property to the open market. This course of action would be taken after discussion with yourself and appointed legal representative.
- Should an alternative purchaser be found, FRDC Ltd will return the deposit money to you less the agreed amount which is retained to cover administrative costs as advised and the contract will be declared null and void.
- If in due course you are unable to sell your property and then wish to buy an alternative property from Wombwell Homes, we will be pleased to discuss fresh terms with you at that time.
Management Structure and Costs
All 8 units will be sold on 999 year leases. Ground rent will be payable at £75 per year which equates to £6.65 per unit per month. Each unit will have a dedicated numbered parking space.
The existing Managing Company will control all maintenance, management etc for which a charge of 10% of actual management expenditure will be levied Each leaseholder will have a vote when matters are due for consideration by the Management Company.
The management costs, divided equally between the whole Brunel Quays Development, amount to approximately £18.10 per unit per week.
